This might involve providing an expert opinion about a persons capacity via a CoP3 report, which is a form used by the Court of Protection, or completing a more detailed expert witness report.
Our assessments are robust and follow the legal requirements set out in the Mental Capacity Act 2005, or case law, so that they are legally sound and meet the highest quality standards. This process can be critical for a person because it determines if a person can make informed decisions about specific aspects of their life, should this be in doubt. Decisions might include:
- Consenting to medical treatment, care and support arrangements.
- Choosing accommodation and living circumstances.
- Managing money and making particular financial decisions.
- Managing legal matters, such as the ability to litigate or testamentary capacity.
